These Terms and Conditions apply to all agreements for the rental of student accommodation concluded between Abdul Salaam Find Me Accommodation UG (haftungsbeschränkt), [Address], Germany (hereinafter referred to as the “Landlord”) and the tenant (hereinafter referred to as the “Tenant”), via the website, email, or any digital communication channels (e.g., WhatsApp, Telegram, Facebook).

1. Scope of Application

  1. These Terms and Conditions apply to all rental agreements for student accommodation concluded by the Landlord and the Tenant.
  2. The agreement applies to accommodation intended solely for temporary use for study-related purposes.
  3. These Terms and Conditions are binding upon acceptance by the Tenant via the website or other communication channels.

2. Subject Matter of the Contract

  1. The Landlord rents furnished accommodation exclusively for temporary use for study-related purposes.
  2. Commercial use, permanent residence, or subletting is not permitted.
  3. A rental agreement is only concluded upon written or electronic confirmation by the Landlord.

3. Term of the Contract

  1. The rental agreement is concluded for a fixed term, as specified in the individual rental contract.
  2. Ordinary termination of the contract before the agreed end date is excluded, unless otherwise agreed in writing.
  3. The right to extraordinary termination for good cause remains unaffected.

4. Rent and Additional Costs

  1. The agreed rent includes ancillary costs such as electricity, water, heating, and internet, unless expressly stated otherwise.
  2. Rent must be paid in advance by the due date specified in the contract.
  3. In the event of late payment, statutory default interest may be charged.

5. Security Deposit

  1. The Landlord may require a security deposit.
  2. The deposit serves to secure all claims arising from the rental relationship.
  3. The deposit will be refunded after the end of the rental period, provided no justified claims exist.

6. Payment Methods

  1. Payments may be made via PayPal or SEPA bank transfer.
  2. Any fees charged by the payment service provider shall be borne by the Tenant, insofar as legally permissible.

7. Handover and Return of the Accommodation

  1. The accommodation will be handed over at the agreed time.
  2. The Tenant undertakes to treat the accommodation and its furnishings with care.
  3. Upon return, the accommodation must be handed back in a condition in accordance with the contract.

8. Tenant Obligations

The Tenant undertakes to:

  • Comply with the applicable house rules.
  • Avoid disturbing other residents.
  • Report any damage immediately.
  • Comply independently with statutory registration obligations (e.g., local registration office).

9. Liability

  1. The Landlord shall be liable only in cases of intent and gross negligence.
  2. The Landlord assumes no liability for items brought in by the Tenant.
  3. The above limitations of liability do not apply in cases of injury to life, body, or health.

10. Internet and Shared Facilities

  1. If internet access is provided, no guarantee is given regarding availability or bandwidth.
  2. The Tenant is responsible for lawful use of the internet connection.

11. Data Protection

Personal data is processed in accordance with the Landlord’s Privacy Policy, which is published on the website and made available to the Tenant.

12. Right of Withdrawal

  1. If the contract is concluded as a distance contract, the statutory right of withdrawal applies.
  2. The right of withdrawal may expire prematurely if the contract has been fully performed.

13. Final Provisions

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

The laws of the Federal Republic of Germany shall apply.

The place of jurisdiction shall be the registered office of the Landlord, insofar as legally permissible.
